UPDATE: ACR Project Alerts Ohio AG Yost to Public Records Documenting That Wright State Administered Racial Scholarships Far More Directly Than Previously Known
Earlier this year, through our in-state co-counsel Ben Flowers of Ashbrook Byrne Kresge Flowers, we alerted Ohio Attorney General Dave Yost that, despite AG Yost’s 2023 directives to comply with federal nondiscrimination law, Wright State University was systematically violating the U.S. Constitution and Title VI of the Civil Rights Act through racially exclusive scholarships. Now, through another Flowers letter (you can read a copy, below), we’ve updated both the school and AG Yost that the situation is worse than we’d initially realized.
The ACR Project followed up on our prior letter with a public-records request to the Wright State University Foundation. The produced records seemingly document that Wright State continued to flout AG Yost’s instructions more directly than we’d previously realized, at least through the beginning of this year. They leave open whether Wright State continues to disregard those instructions.
We’ve asked for clarification by December 1st. Public institutions should listen to their public’s elected lawyers and comply with America’s clear laws against this kind of racial discrimination.
