Reports indicate that San Diego is set to “push” a “challenge” to the California State Constitution’s prohibition against racial discrimination in public contracting, despite the actual knowledge of all involved that it would violate at least the state Constitution (and likely violate federal law, as well).

Today, the ACR Project contacted the City of San Diego, highlighting the illegality of this “push,” the documented fact that the City Council already knows of its illegality, and the resulting potential under federal law for  any and all officials adopting or implementing the policy to acquire personal liability for their intentional violation of American’s civil rights while acting under color of law.
